I'm not either, but it is allowed. I'm not sure if the kernel team will 
want to apply the patch or just wait until this gets included with a next 
upstream release.

It looks like the patch has not yet been accepted upstream, or at least 
it's not yet been included for 2.6.22-rc3. Therefore not setting the 
patch tag.
