I think this is exactly the right way to look at outside expertise. An expert (in this case a lawyer) can give us information on trade offs related to legal risk (both to potentially losing in a legal action and to having to spend significant project resources even if we win), but the project has to make the decision about what level of risk it is willing to accept.
